Governing law

These Terms are governed by the laws of the Republic of Austria, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Venue

For disputes with users acting in a commercial, business, or professional capacity, the competent courts for the registered place of business (Gewerbestandort) of Ing. Philipp Zöchner (Einzelunternehmer), located at Sackstrasse 26, 8010 Graz, Austria, have exclusive jurisdiction.

Consumer protection — your rights are preserved

If you are a consumer, mandatory consumer-protection law applies regardless of the venue clause above. In particular:

  • If you are domiciled in the European Union, you retain the forum rights granted by Articles 17–19 of Regulation (EU) No 1215/2012 (Brussels I-bis), including the right to bring proceedings in the courts of your own domicile and the right to be sued only in those courts.
  • If you are domiciled in Austria, you additionally retain the protections of §14 of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG), including the home-forum rule for consumer contracts.
  • Equivalent mandatory consumer-forum and consumer-protection rules under German, Swiss, and other applicable national laws are preserved and override the venue clause to the extent of any conflict.
  • Under Article 6(2) of Regulation (EC) No 593/2008 (Rome I), the choice of Austrian law does not deprive you, as a consumer, of the protection afforded by mandatory provisions of the law of the country in which you are habitually resident.

Disputes

Disputes are resolved before the competent courts identified above. There is no arbitration clause in these Terms.

EU Online Dispute Resolution

Consumers domiciled in the European Union may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to lodge a complaint. We are not, however, obliged or willing to participate in dispute-resolution proceedings before a consumer arbitration board.
